I have this friend who has joined Bel'air for more than a month. She asked for my suggestions when she was considering to join it. I gave her the link to this forum and some other forums. But still she did not listen to me.
Last night, she called me and told me that she felt very bad now. All she has learnt is how to cheat people. She wants to run away from the company. Unfortunately, she has put in an investment of S$14000 and she is finding a way to get it back now. Has anyone experienced the same thing before? Is there anyway to get the money or part of the money back?
I would greatly appreciate if anyone could help me. She is kind of my best friend. Thanks in advance. -
First, we are in same boat. I lost my close friend because she decided to join Bel Air and ignored what I told her about it. Im so far away from Singapore to be able to do anything about this. I threw our relationship on the table to beg her to think again but there was no use at all. It was like 2 weeks already and I am worrying about this problem.
Second, as far as I know your friend can get 90% refund within 3 months according to Bel Air's site. So tell her to contact with Bel Air and ask for cancelling the contract. But I do not know when your friend will receive the money back. Maybe 1 month, 3 months or 1 year? God bless your freind and please tell me about results then. -
Just go to the HQ at commonwealth, bring all the remaining stocks and invoices. Approach the staff and say want to return stocks (only stocks that are not under promotion and unused can return). Your friend is protected by law to do this - not to worry. In the process, your upline Marquis will be informed. Also, they may ask you whether your friend can wait, after until the company collected the $ from the distributors (those who got their commission from your friend investment). Say it in affirmative - NO. Let the company deals with her uplines.
Also, please do it fast (within 3 months from the date of purchase) and in-secret (without informing your friends upline). Because, if they were to know it in advance, they may try everything within their capacity and power to prevent your friend from doing so. They are good at this.
Go directly to CASE or CAD if they do not in any way entertain your request. Not to worry and best wishes.
Your friend will be alright.

My friend did think about withdrawing after listening what I told her. I told her not to talk to her upline or anyone in her group and do it alone but she didnt. She told anyone in the group about that intention and 3 days later she answered me that she could not withdraw. The upline convinced her something and she's brainwashed again. So now she's immuse to anything I tell her. It's sad but true. So one advice from me is do not let your friend alone in this time. Go with her if possible to solve anything involving. Hope the best for you guys. -

Thanks a lot, u guys. Unfortunately, my friend has already told her upline. They told her to find someone to replace if she wants to get back 100% of the money. By end of next week, if she can't find anyone, I will go with her to Commonwealth. Hope everything will go well. Thanks a gain for all your information.

Hi pls be reminded ur frd has the RIGHT to get back the money as stated in the terms and conditions even if she cannot find anyone to replace her. If not, it will be like her upline is there to cheat her money.

I am very sure that she need not find someone for replacement. It is not within the guideline.
Off course, her friend(upline) may not be happy or comfortable because she has to pay commission back to the company.
You can find a replacement, unless that replacement is willing to pay your friend's investment and stock. And by doing so her upline can keep her networks and not worry about paying commission back to company.
I am also very curious to know which network groups she joined? can tell me or mayb in send me a pte msg? It's bad. I got the same situation. My friend told me they convinced her to wait for them to find another replacement so she can get back 100%. But at that time she could get back 100% without waiting because it was just 1 week. Now it is late and she has no choice but continue to test in the next 2 months before thinking about withdrawing with 90% left. But I am afraid that she wont withdraw after the next 2 months because they will try to prevent it and make it late for her agian. I have a frd who lost his invoice and the company said he cannot refund. Do u think u can help?

I asked my friend to check the money return policy in the contract so that we have somethings to lean on. However, she told me that there was no contract. She only signed a distributor form. Do u guys know any Law or Atc about this? Or happen to know Bel air policy somewhere? I think it would be much easier if i have some documents in my hand when i argue with them...

I am not sure. But definitely, Bel'Air company has all the distributors' record. My understanding is that they can reprint the invoices. In fact, for every distributor, the company files exactly one copy of invoice, for that I am sure.
It is a gray area, because the company can say that your friend have no records to prove it. I am just thinking whether your friend can make a police report about losing the invoices and using that claim to request Bel'Air to reprint the invoice.
Your friend can seek help from CASE, I believe. So long as he is really keen and genuine to withdraw his membership. If you choose to withdraw from the business within 14 days, the company will give you a 100% refund of your original investment. If you withdraw within 90 days, you will be given a 90% refund.

the commissions can be a few thousands depending on the amount the person invested. Bel'Air is a little unlike the rest of MLM companies. By just investing one COUNT, the upline will get somewhere around $3000. (or maybe $2000)

What if after receiving comission for like $20,000 from the company and he decided to withdraw ^^. 3 months later the downline wants to retreat too. Who will pay the donwline back?

This is a very good question. You are already into it.
That is why whenever someone withdraw at the office, the staff will ask "can you wait for the company to get back the commission from the all the distributors?" Always say "NO", because most of the time the distributors will either act blur or say "no money". The company will pay the person who withdraw first and automatically cut the money on the next pay cheque from all distributors who are involved. This is from Bel air "No risk. If you choose to withdraw from the business within 14 days, the company will give you a 100% refund of your original investment. If you withdraw within 90 days, you will be given a 90% refund."
In the MLM and Pyramid selling (prohibition) Act :
vii) the commodity shall be distributed with a full refund or buy-back guarantee that is execisable by every participant in the scheme or arrangement on reasonable commercial terms and within a period of at least 60 days from the date of distribution of the comodity to the participant
My friendhas joined for more than 14 days but less than 60 days. Do you guys think i can use the Act to get the full-refund?
By the way, i have convinced my friend. We re going to Commonwealth tomorrow... -

So the company cant get the money back from the upline, rite? because the upline is not in the company anymore. Ok I see your question. Answer "NO" when the question ask. Let the company deal with it. The company will pay first. Never answer "YES" because the company may never get back from distributors.
As far as I can understand under the guidlelines, the company by hook or by crook will need to return the $. Provided it is done within the warrantied period. -
It's a nice question too. The problem is the phrase "on reasonable commercial terms" can prevent you get full refund as the Act stated. Because they can claim it for 10% damage from your order that causes to the company. For example, shipping, handling cost, blah blah. As far as i know the 10% charge is on admin. In other words, after 14 days, they will charge 10% for the admin duties. Within 14 days they will not charge anything-means full 100% refund...since in 14 days it's difficult to say if this biz works for u.. u can nv get back ur full 100% refund.
